Education Act 1990 (NSW), Part 7 Subdivision 5 'Registration for home schooling' — s71 (application), s72 (registration), s73 (conditions and 2-year maximum duration, tying home schooling to Part 3's minimum curriculum), s74 (cancellation). Registration authority sat with NESA (the NSW Education Standards Authority) until it transferred to the NSW Department of Education on 5 May 2025; NESA remains the syllabus-setting body under the Education Standards Authority Act 2013.

Visits
An Authorised Person (a Department inspector or appointed officer) conducts a home visit to assess the proposed program before initial registration, and again at each renewal to review implementation records — the child must be sighted barring exceptional circumstances. Typical time from application to certificate is 7–12 weeks; families are advised to apply about 3 months ahead of their intended start date.

Up to 2 years (statutory maximum); initial grants are often shorter, since delivery records don't yet exist to demonstrate
