- Education Act 1990 (NSW), Part 7 Subdivision 5 'Registration for home schooling' — s71 (application), s72 (registration), s73 (conditions and 2-year maximum duration, tying home schooling to Part 3's minimum curriculum), s74 (cancellation). Registration authority sat with NESA (the NSW Education Standards Authority) until it transferred to the NSW Department of Education on 5 May 2025; NESA remains the syllabus-setting body under the Education Standards Authority Act 2013.

- Visits
- An Authorised Person (a Department inspector or appointed officer) conducts a home visit to assess the proposed program before initial registration, and again at each renewal to review implementation records — the child must be sighted barring exceptional circumstances. Typical time from application to certificate is 7–12 weeks; families are advised to apply about 3 months ahead of their intended start date.

If your guest isn't working at year level
Most families who home educate are doing it because school stopped working, and a great many are doing it for a child who would not manage a set task today. This is what New South Wales actually asks in that situation.
This authority's registration test is referenced to a curriculum. Your program is expected to be built from it, so the ladder below — where the authority publishes one — is how it accommodates a child who cannot access the outcomes for their year.
Select the Stage or Stages for each subject
Home schooling parents may choose from the syllabus stage statements, outcomes and/or content to prepare the child's program, and may select the Stage or Stages for each subject. Registration requires that the minimum curriculum of the Act is provided — the program is based on and taught in accordance with the relevant NESA syllabuses.

Adjustments
Actions taken to enable a child to access syllabus outcomes and content, relating to teaching methods, learning activities and assessment processes according to the needs of the child. NESA's own examples include sequencing material in a different order, simplified texts, both oral and visual input, different mediums and technologies, covering a limited amount of material in any one session, and providing more or less time.

An earlier Stage, selected
Stages are Early Stage 1 (Kindergarten), Stage 1 (Years 1–2), Stage 2 (Years 3–4), Stage 3 (Years 5–6), Stage 4 (Years 7–8), Stage 5 (Years 9–10) and Stage 6 (Years 11–12). Because parents select the Stage per subject, an earlier Stage is chosen rather than applied for.

Life Skills courses
Where adjustments do not provide sufficient access to some or all of the syllabus outcomes, a Life Skills course may be appropriate. For children unable to access the mainstream syllabus outcomes, particularly children with an intellectual disability. NESA publishes Life Skills courses in Stages 4 to 6 (Years 7 to 12) — SO THERE IS NO LIFE SKILLS COURSE FOR KINDERGARTEN TO YEAR 6, where adjustments and Stage selection are the available routes.
