Terms of Service

The short version

  • An adult with parental responsibility holds the account. Children never sign up.
  • Cancel any time, yourself. Annual plans get unused whole months back.
  • When you leave, you keep twelve months to print your records.
  • We are not a school, we do not register you, and we promise nothing about how your child will do.
  • Your rights under Australian Consumer Law cannot be signed away — including by anything here.

1. Who this agreement is between

These terms are an agreement between ParkSyde Life Pty Ltd (ABN 14 678 837 468) of Rockhampton, Queensland — and online everywhere(“ParkSyde”, “we”, “us”) and the adult who creates the account (“you”).

You must be 18 or over and the parent or legal guardian of every child you add, or otherwise legally responsible for their education. We ask you to confirm that when you create the account, and we record when you did. Children do not create accounts, do not agree to these terms, and we do not contact them directly — everything comes to you.

2. What you are buying

A subscription gives your family, for as long as it is active:

  • the ParkSyde Learning curriculum for every year level, as it exists at the time;
  • Progressive Diagnostics and the strand-level tailoring that follows from them;
  • a learning record that assembles as your child works, which you can print;
  • one Learning Start consultation per learner, per 12 months, with a registered teacher, counsellor or psychologist;
  • further consultations if you want them, arranged through the Support Hub.

We say plainly what this is not. A full Australian school year is roughly 1,000 hours of teaching. ParkSyde is a spine to build your year around, not a replacement for one. We publish the current size of the curriculum on our pricing and curriculum pages, counted from the content itself, so you can judge it rather than take our word for it. More units are authored over time and that figure moves.

3. What ParkSyde is not

Not small print — the four things most likely to be misunderstood, and we would rather you knew before you paid.

  1. We are not a school, and we issue no credential. Nothing here leads to an ATAR, a QCE or any certificate. We teach, and we record what was taught.
  2. We do not register you and cannot make you compliant. Home education registration is decided by your state or territory registrar, and requirements differ between them. Our records are built to help you evidence learning; whether they satisfy your registrar is their decision.
  3. We make no promise about how your child will do. No catch up, no outcome, no guarantee of progress. Anyone promising you that about a child is guessing.
  4. We do not claim ParkSyde is more effective than alternatives. Our methods rest on published research, cited on our evidence page. The product has not been trialled against a control and we will not say otherwise until it has.

4. Your account

You are responsible for keeping your sign-in private and for what happens under your account. Tell us promptly if you think someone else has access.

One account covers one family. Please do not share your sign-in with other families — not because we are policing it, but because your child's learning records and your consultation history sit behind it.

5. Price and billing

  • $119 per month for the first learner, or $1,190 per year (two months free).
  • $79 per month for each additional sibling.
  • All prices are in Australian dollars and include GST.

Payments are processed by Stripe. We never see or store your card details. Subscriptions renew on the date you started until you cancel.

Price changes. We give you at least 30 days' notice by email, and a change never takes effect before your next renewal. If you do not want to continue at the new price, cancel before then and you will not be charged it.

6. Cancelling and refunds

Cancel at any time, yourself, from the billing portal in your account. You do not have to email us, ask permission, or give a reason. Your subscription stays active until the end of the period you have paid for.

Monthly plans run to the end of the month you have paid for, and nothing is refunded.

Annual plans are refunded pro-rata for every whole unused month. Cancel in March on a plan that started in January and you are refunded for the ten months you will not use. Nothing is deducted for a Learning Start consultation you have already had.

Where the Australian Consumer Law entitles you to a remedy, that applies regardless of anything in this section.

7. Your rights that we cannot take away

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies them — and if any part of this agreement tried to, that part simply does not apply.

Among other things, services must be supplied with due care and skill, be fit for the purpose we said they were for, and be supplied within a reasonable time.

If we fail one of those guarantees you may be entitled to a remedy — a refund, a re-supply, or compensation for reasonably foreseeable loss. For a major failure you may cancel and seek a refund.

If you think something has gone wrong, tell us before you tell anyone else. We would rather fix it.

8. Your child's records, and what happens when you leave

This matters more than the rest of this page. For a home-educating family the evidence trail is not a nice-to-have — it may be what your registrar asks to see, possibly years later.

While you are subscribed, print or export your child's learning record any time, as often as you like.

After you cancel, your account stays readable in export-only mode for twelve months. You cannot open lessons, diagnostics or consultations, but you can sign in and print the full learning record for every learner, at no cost. A banner tells you the date it closes. After that we delete it.

Twelve months is not arbitrary: a registrar works on an annual cycle and can ask about a year that has already finished.

You can also delete your account and everything in it, yourself, immediately, at any time.

Two exceptions, which we would rather tell you now than when they matter.

  1. If you tell us something indicating a child may have been harmed, we keep that record even if you delete your account. We must be able to account for how we responded, and there is no time limit on when that can be asked of us.
  2. Notes a psychologist, counsellor or teacher writes about a consultation are health records. They are kept apart from the learning platform, they are not ours to delete on request, and they are held until the child turns 25 or seven years after the last appointment, whichever is longer. Only the practitioner who wrote a note can read it.

Everything else goes when you do, and we keep no copy of it. How we handle information says the same thing in the same words.

9. Who owns what

Your family's work is yours. Anything your child writes, draws, records or uploads belongs to you. We do not claim it, we do not use it to advertise, and we do not use it to train anything.

Our teaching material is ours.The lessons, units, diagnostics and platform remain ParkSyde's property or our licensors'. Use them for your own family's education, print them, adapt them for your own children — but please do not resell them, publish them, or use them to run a service for other families.

10. Using ParkSyde decently

Do not use ParkSyde to harm anyone, to break the law, or to attack the service. Do not attempt to reach another family's records. Do not share your access outside your family.

If you contact one of our professionals, please be civil. They are people, and they are often reading something hard.

11. Changes, suspension, and things going wrong

We may change the service. Units are added and improved continuously. If we remove something substantial you rely on we will tell you, and if that makes ParkSyde not what you paid for, section 7 applies.

Changes to these terms get 30 days' notice by email and take effect at your next renewal. If you do not accept a change, cancel before then.

We may suspend or end an account for non-payment, for a serious breach of section 10, or where we reasonably believe it necessary to protect a child. Where we can, we will tell you why and give you a chance to respond. If we end your account for a reason that is not your fault, we refund the unused portion.

Our liability.We are responsible for loss we cause that is reasonably foreseeable. We are not responsible for a registrar's decision, for how your child progresses, or for loss caused by something outside our reasonable control. Nothing in this paragraph limits section 7.

12. Concerns, complaints and child safety

If something is wrong, email admin@parksydeltd.com or call 0467 937 659.

If you are worried about a child's safety, or about how someone at ParkSyde has behaved, you do not need an account and you do not need to use any form. Contact us by either of the above. We will tell you what we are doing about it, and you can raise a concern anonymously. If a child is in immediate danger, call 000 first.

If we cannot resolve a complaint between us, you can take it to the Queensland Office of Fair Trading or the ACCC.

13. Governing law

These terms are governed by the law of Queensland, Australia, and both of us submit to the courts of that state. This does not take away any right you have to bring a claim where you live.
